Please read these Terms and Conditions carefully. They govern your use of theautomedic.com, any related online forms or customer pages, and automotive services requested from or provided by The AutoMedic. By submitting a request, approving an estimate, scheduling an appointment, authorizing work, or using our services, you agree to these Terms. If you do not agree, do not submit a request or authorize services.

1 About The AutoMedic

The AutoMedic is a mobile automotive service business based in Newport Beach, California, serving eligible locations in Orange County. Services may include mobile diagnostics, maintenance, repairs, battery service, emergency battery assistance, brake service, and pre-purchase inspections. Service availability depends on the vehicle, requested work, parts, location, technician availability, site conditions, and other factors.

The AutoMedic provides automotive services directly and is not merely an online marketplace or referral venue. If any portion of authorized work will be performed by another facility or service provider, we will disclose that arrangement and obtain consent when required by law. The AutoMedic remains responsible for that work to the extent required by California law.

2 Eligibility and authority

You must be at least 18 years old and legally able to enter into a contract to request or authorize services. By requesting service, you represent that you are the vehicle owner or have the owner’s permission and legal authority to request information, approve estimates, authorize diagnosis or repair, provide access to the vehicle, and make payment.

If a company, dealer, fleet, family member, buyer, seller, or other person is involved, the person approving work represents that they are authorized to act for the customer. A customer may designate another person to authorize additional work only as allowed and documented under applicable law.

3 Website requests quotes estimates and authorizations

3.1 A request is not an appointment or repair authorization

Submitting a website form, text message, email, voicemail, or request for emergency battery assistance does not by itself create an appointment, guarantee availability, authorize diagnosis or repair, or require The AutoMedic to perform service. An appointment exists only after The AutoMedic confirms it.

3.2 Quotes and preliminary pricing

Website pricing, telephone pricing, and preliminary quotes may rely on information supplied by the customer and may be subject to vehicle identification, battery or part fitment, physical inspection, diagnostic findings, parts availability, programming requirements, service location, taxes, and other job-specific conditions. A quote may expire on the date stated in the quote. If no expiration date is stated, pricing remains subject to verification before authorization.

3.3 Written estimates and customer authorization

Before repair work begins, The AutoMedic will provide the estimate and obtain the authorization required by California law. No repair work will be performed and no repair charge will accrue before the required authorization is obtained. Authorization may be written, oral, or electronic when permitted by law and will be documented in the service record.

If additional diagnosis, parts, labor, or a different repair method becomes necessary, The AutoMedic will provide the required revised information and obtain additional authorization before performing the additional work or allowing additional repair charges to accrue. A customer may decline additional work.

3.4 Job-specific documents control

The written estimate, repair order, revised authorization, booking confirmation, final invoice, and any written warranty are part of the agreement for the specific job. If a job-specific document conflicts with these Terms about the scope, price, parts, authorization, timing, cancellation terms, or warranty for that job, the job-specific document controls. Mandatory consumer protections always control over conflicting contract language.

4 Customer information and vehicle identification

You agree to provide accurate, current, and complete information, including your contact information, vehicle year, make, model, mileage, vehicle identification number or license plate and state when requested, symptoms, warning lights, prior repairs, modifications, damage, parking conditions, access instructions, and service location. You must promptly correct information that is inaccurate or changes.

The AutoMedic may rely on the information you provide when identifying parts, estimating work, planning equipment, and scheduling service. Inaccurate or incomplete information may delay service, change pricing, require a revised estimate, or make the requested work unavailable. No additional charge will be made without the authorization required by law.

5 Mobile service location and access

The customer must provide a lawful, reasonably level, stable, well-lit, and safe work area with enough clearance for the requested service. The customer is responsible for obtaining permission from the property owner, manager, employer, dealer, parking facility, homeowners association, or other person controlling the location. The vehicle must be accessible at the confirmed time, with keys, wheel-lock keys, alarm instructions, and other necessary access available.

The AutoMedic may refuse, stop, relocate, or reschedule work if the location, traffic, weather, vehicle position, hazardous materials, aggressive animals, unsafe conduct, inadequate clearance, property restrictions, or another condition creates a safety, legal, or practical concern. Any applicable service-call, cancellation, or rescheduling fee must be disclosed and agreed to before it is charged.

The customer should remove valuables and sensitive personal property from the work area and vehicle. The AutoMedic is not responsible for loss of undisclosed property that was not placed in our custody, except to the extent caused by our negligence or other conduct for which liability cannot lawfully be limited.

6 Appointments arrival windows cancellations and delays

An offered or selected time is a service arrival window unless The AutoMedic expressly confirms an exact time. Traffic, weather, prior appointments, parts delays, vehicle condition, access problems, and events outside reasonable control may affect arrival or completion. We will use reasonable efforts to communicate material delays and arrange a practical alternative.

Cancellation, rescheduling, no-show, deposit, travel, diagnostic, special-order part, or similar terms will be disclosed before booking or authorization when they apply. A fee or nonrefundable amount is enforceable only to the extent it was disclosed, agreed, and permitted by law. If The AutoMedic cancels a service before it is performed, any amount prepaid solely for the unperformed service will be refunded, less only an authorized and lawful charge for items already supplied or costs already incurred for the customer.

7 Diagnostics inspections and repair limitations

7.1 Diagnostic services

A diagnostic service is a professional assessment based on the symptoms, vehicle condition, accessible systems, test results, information available, and scope authorized at the time of service. Some problems are intermittent, hidden, related to multiple systems, or cannot be confirmed without additional testing, disassembly, repair, or observation over time. A diagnostic opinion is not a guarantee that every existing or future condition will be identified in one visit.

If disassembly or a tear down is necessary to diagnose a condition, The AutoMedic will provide the estimate, disclosures, and authorization required by California law before beginning that work.

7.2 Pre-purchase inspections

A pre-purchase inspection is a non-destructive evaluation of the vehicle’s reasonably accessible condition at the time and place of inspection, within the scope shown in the applicable estimate or inspection order. Findings may include visual observations, photographs, video, diagnostic information, a road test when permitted and safe, and recommendations. The inspection is not a warranty, guarantee, certification, appraisal, emissions inspection, smog inspection, title report, lien search, recall clearance, or prediction of future reliability or repair cost.

A pre-purchase inspection may not reveal concealed damage, intermittent faults, internal wear, recently cleared diagnostic codes, conditions hidden by components or coverings, fraudulent seller conduct, unavailable records, or conditions that require dismantling, specialized equipment, laboratory analysis, or extended driving to identify. The customer remains responsible for the purchase decision and may obtain title, history, recall, emissions, financing, and specialist reviews from appropriate sources.

Unless The AutoMedic agrees otherwise in writing, an inspection report is prepared for the customer who ordered it and for that customer’s evaluation of the inspected vehicle. A seller, dealer, lender, insurer, or later buyer should not treat the report as a guarantee or substitute for its own review.

7.3 Safety-related conditions

If we identify a condition that may affect safe operation, we may recommend that the vehicle not be driven until properly repaired or evaluated. The customer is responsible for deciding whether and how the vehicle is moved after receiving that information. The AutoMedic does not declare a vehicle roadworthy, safe, compliant, or fit for a particular purpose unless a specific written document expressly states that conclusion and the law permits it.

8 Battery and emergency battery services

Battery pricing and availability are subject to verification of the exact vehicle, battery fitment, terminal layout, battery technology, installation requirements, programming or registration requirements, warranty availability, service location, and current inventory. An emergency request does not guarantee immediate response, a particular arrival time, successful starting of the vehicle, or availability of a suitable battery until The AutoMedic confirms the job.

Emergency battery assistance is an automotive service, not emergency response, roadside rescue, towing, police, fire, or medical service. If the vehicle or location creates an immediate danger, move to a safe place if possible and call 911 or the appropriate emergency or roadside provider. The AutoMedic may decline or stop service where traffic, weather, fire risk, leaking fluids, collision damage, battery damage, access, or another condition is unsafe.

9 Parts replaced parts and outside work

9.1 Parts supplied by The AutoMedic

Parts will be identified and described in the estimate and invoice as required by law. Part brand, source, condition, and warranty may vary by availability and the authorized option. The AutoMedic will not substitute a materially different repair method or part without the authorization required by law.

9.2 Return of replaced parts

A customer may request return of replaced parts before authorizing the work. Parts that must be returned to a manufacturer, distributor, supplier, or warranty administrator, parts sold on an exchange or core basis, and parts that cannot lawfully or safely be returned may be excluded as permitted by law. Applicable exclusions will be disclosed or documented as required.

9.3 Customer-supplied parts

Customer-supplied parts will be installed only if The AutoMedic agrees in writing before the appointment. Unless expressly stated in a written warranty, The AutoMedic does not warrant the design, quality, condition, compatibility, legality, or performance of a customer-supplied part. The customer remains responsible for the part and for authorized additional labor or materials caused by an incorrect, defective, incomplete, or incompatible part. This paragraph does not limit any non-waivable right relating to The AutoMedic’s own workmanship.

9.4 Sublet or outside services

If an authorized job requires work by another facility or provider, The AutoMedic will disclose and obtain consent as required by law. On request, we will provide the name and location of the facility when required. The AutoMedic remains responsible for sublet repairs to the extent required by California law.

10 Prices invoices and payment

The customer agrees to pay the amounts properly disclosed and authorized for the specific job, together with applicable sales tax and any other lawful, disclosed charge. Unless a different written payment schedule applies, payment is due when the authorized service is completed and the invoice is provided. The final invoice will itemize the work performed and parts supplied as required by law, including work performed at no charge or under warranty when required.

A deposit, diagnostic fee, travel fee, cancellation fee, special-order part charge, or other amount applies only when disclosed and accepted before it is incurred. If a third party may pay some or all of a charge, the customer remains responsible for authorized amounts not paid by that third party unless The AutoMedic agrees otherwise in writing.

The customer authorizes The AutoMedic to charge the selected payment method only for amounts that were properly disclosed and authorized. Payment disputes should be reported promptly so the parties can review the estimate, authorization record, work performed, and invoice.

11 Warranties

Any express warranty from The AutoMedic will be stated in the estimate, invoice, or a separate written warranty document. A manufacturer, distributor, or other third party may provide a separate parts warranty governed by its own terms. Warranty duration, covered items, exclusions, claim steps, and remedies are controlled by the applicable written warranty and mandatory law.

A customer requesting warranty review should notify The AutoMedic promptly, provide the related invoice, describe the concern, and give The AutoMedic a reasonable opportunity to inspect the vehicle or part. Emergency or safety needs may require immediate action by another provider; when practical, contact The AutoMedic first and retain the parts, records, photographs, and invoices needed to evaluate the claim.

Nothing in these Terms excludes or limits a warranty, remedy, or consumer right that cannot lawfully be excluded or limited.

12 Customer communications

By providing a telephone number or email address and submitting a request, you authorize The AutoMedic to contact you about that request, including quotes, authorizations, scheduling, arrival updates, service questions, invoices, warranty matters, and related customer service. These operational communications are not a promise that every channel will always be available.

Marketing text messages require any separate consent required by law and are not a condition of purchasing service. Message and data rates may apply. Reply STOP to an automated marketing text to opt out of that text program and HELP for assistance, or contact us at (855) 928-8663. An opt-out may prevent us from sending certain text updates, so provide another communication method when active service is pending.

13 Privacy and customer materials

Our collection and use of personal information are described in the Privacy Policy at https://theautomedic.com/privacy/. Text-message program information is available at https://theautomedic.com/text-opt-in/. These policies are incorporated into these Terms only to the extent applicable to the relevant service or communication.

When you provide photographs, videos, diagnostic records, vehicle information, seller or dealer contact information, messages, or other materials, you represent that you have the right to provide them. You authorize The AutoMedic to use those materials as reasonably necessary to respond to the request, perform and document services, maintain business records, address warranty or dispute issues, and comply with law. Our Privacy Policy governs personal information in those materials.

14 Website use

14.1 Informational content

Website content is general information and does not replace an inspection, diagnosis, written estimate, repair order, manufacturer instruction, recall notice, or safety direction for a specific vehicle. Do not rely on website content to operate a vehicle that may be unsafe.

14.2 Acceptable use

You may use the website only for lawful personal or business purposes related to evaluating or requesting The AutoMedic services. You may not interfere with the website, bypass security, submit false or unauthorized requests, impersonate another person, introduce malicious code, scrape or copy protected content at scale, or use the website to violate another person’s rights.

14.3 Ownership

The website, branding, original text, graphics, layout, forms, and other content supplied by The AutoMedic are owned by or licensed to The AutoMedic and are protected by applicable intellectual property laws. You may view and print reasonable copies for personal evaluation of our services, but you may not reproduce, publish, sell, modify, or commercially exploit the content without written permission.

14.4 Third-party services and links

The website may link to or use third-party mapping, payment, scheduling, vehicle-data, messaging, review, analytics, or other services. Their own terms and privacy practices may apply. The AutoMedic is not responsible for third-party content or systems outside our control, but this does not reduce our responsibility for automotive services or customer records where the law makes us responsible.

15 Disclaimers and limits of liability

The website is provided on an as-available basis. To the fullest extent permitted by law, The AutoMedic does not promise that the website will be uninterrupted, error-free, or free from every harmful component. This website disclaimer does not change the obligations stated in an authorized estimate, repair order, invoice, or written warranty.

To the fullest extent permitted by law, The AutoMedic is not liable for indirect, incidental, special, exemplary, or consequential damages that were not reasonably foreseeable from a breach, including loss of use, lost profits, lost opportunity, or substitute transportation, except where such a limitation is prohibited by law or a written job-specific agreement provides otherwise.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury, property damage caused by negligence, violation of the Automotive Repair Act, or any other liability or remedy that cannot lawfully be excluded or limited. Nothing in these Terms shifts to the customer a loss caused by The AutoMedic where California law makes The AutoMedic responsible.

16 Events outside reasonable control

The AutoMedic is not responsible for delay or failure caused by events outside reasonable control, such as severe weather, unsafe road conditions, traffic closures, fire, flood, earthquake, utility or communications failure, government action, civil emergency, supplier disruption, or sudden technician illness. This section does not excuse payment refunds or other remedies that applicable law requires for services not performed.

17 Resolving concerns

Please contact The AutoMedic first so we can review the service record and try to resolve the concern promptly. Contacting us does not waive or delay any right to seek help from a regulator or court, and these Terms do not require private arbitration.

Unresolved questions regarding automotive service work may be submitted to the California Bureau of Automotive Repair. Consumers may visit https://www.bar.ca.gov/ or call the California Department of Consumer Affairs at (800) 952-5210. The Bureau of Automotive Repair lists its mailing address as 10949 North Mather Boulevard, Rancho Cordova, CA 95670.

18 Governing law and venue

California law governs these Terms, without regard to conflict-of-law principles, except that mandatory law may require a different result. Any court proceeding relating to these Terms or The AutoMedic services may be brought in a court with lawful jurisdiction in Orange County, California, except where applicable law permits or requires another venue. Small claims rights and administrative complaint rights remain available.

19 Changes to these Terms

The AutoMedic may update these Terms from time to time. The updated version will show a new effective date and will apply prospectively. The version in effect when a customer authorizes a specific service will govern that service unless the customer agrees to a later version or applicable law requires otherwise. A change to the website Terms does not retroactively change an already authorized estimate, warranty, or payment obligation.

20 General provisions

If any provision of these Terms is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. A delay in enforcing a provision is not a waiver. The customer may not transfer an appointment or service agreement without The AutoMedic’s consent, except where law permits. The AutoMedic may assign these Terms as part of a sale, reorganization, or transfer of the business, subject to applicable law and privacy obligations.

These Terms, together with the applicable job-specific documents and incorporated policies, are the agreement concerning their subject matter. They do not create rights for a person who is not a party to the applicable transaction, except where law provides otherwise.
